No bail if specific allegations of rape, murder found: HC

Staff Correspondent: The Appellate Division of the Supreme Court has issued a 16-point directive over anticipatory bail that orders not to grant bail to any accused when specific allegation of rape and murder is found.

The court came up with the directives while handing down an order over granting bail in advance to BNP Secretary General Mirza Fakhrul Islam Alamgir and Oikyfront leaders in a sabotage case.

The court also issued a directive not to grant bail to someone more than eight weeks.

The Appellate Division also ordered law enforcement agencies to follow the article 32 of the constitution while arresting any accused.

For the HC Division, the Appellate Division said, “The FIR must have to be observed exquisitely. Condition will have to be slapped bail that intimidation will scrap the bail and nobody will be granted for indefinite period.

Mentionable, The Appellate Division on April 18 settled the stay petition filed by the state over the bail granted 14 to BNP leaders including the party SC Mirza Fakhrul Islam Alamgir.

On August 7, a 7-member Appellate Division bench led by the Chief Justice Syed Mahmud Hossain published the order.

According to the verdict, the accused must surrender before the trial court within two weeks.
