HC order over Abdul Hyee’s MP post stayed

The Chamber court stayed the High Court (HC) order that suspended a gazette issued by the Election Commission (EC) declaring Abdul Hyee, a lawmaker of Jhenaidah-1 from Awami League, as the winner in the 12th national parliamentary election held on January 7.

As a result of this, there is no bar for Abdul Hyee to perform duties as the MP, lawyers said.

The chamber court judge of the Appellate Division of the Supreme Court, Justice M Enayetur Rahim, passed the order on Monday (February 5).

Earlier on February 1, Justice AKM Asaduzzaman’s single High Court bench suspended a gazette issued by the Election Commission (EC) declaring Abdul Hyee, a lawmaker of Jhenaidah-1 from Awami League, as the winner in the 12th national parliamentary election held on January 7. 

Md Abdul Hyee was declared the winner as he bagged 94,379 votes, while his closest rival Nazrul Islam got 80,547 votes in the January 7 election. Nazrul filed the election petition, accusing Hai of violating the election code of conduct.

Earlier on January 2, a case was filed against Abdul Hyee for violating the electoral code of conduct.
