HC issues rule on stopping doctors’ pvt practice

Staff Correspondent: The High Court has issued a rule asking the government to explain why the relevant law ((Section 4 of the Medical Practice and Private Clinics and Laboratory Ordinance in 1982) that allows state-appointed doctors to run private practice should not be declared unconstitutional.

The High Court bench of Justice FRM Nazmul Ahsan and Justice KM Kamrul Kader came up with the order and rule on Tuesday following a writ petition filed by five Supreme Court lawyers seeking directives to stop private practice of government-appointed doctors.

The High Court also directed the government to form an independent commission to frame a guideline for the state-appointed doctors who also run private practices.

On the petition filed February 4, the lawyers prayed the formation of a commission for introducing a guideline on private practice of the government-appointed doctors, and to conduct mobile courts to stop irregularities at government and private hospitals.

 

Five lawyers who filed the writ are Abdus Sattar Paloyan, Salahuddin Regan, Sujat Mia, Md. Aminul Haque and Md. Kawsher Uddin Mondal.

Secretary of the Health Ministry, Director General of Health Directorate, President of Bangladesh Medical and Dental Council (BMDC) and President of Bangladesh Medical Association (BMA) are made defendants.
