The Supreme Court Bar Association (SCBA) has demanded withdrawal of the open letter sent by Nobel laureates and others across the world to stop the ongoing trial proceedings against Dr Muhammad Yunus.
Supreme Court Bar Association (SCBA) issued a statement in this regard on Friday (September 1).
“The contents of the letter are based upon incorrect information. They would not write such a letter if they could know the truth,” said the statement
It also said, “This letter is an undue interference in the internal affairs of Bangladesh and is an interference in the independent judicial administration on the one hand. On the other hand, it is a mischievous stand against the legal and legitimate right and interest of the poor labours. It is unexpected unwarranted to the world leaders.”
The ongoing judicial process against De. Muhammad Yunus for hampering interest of the Labours and Tax invasion are the demand of law and natural justice. Bangladesh Supreme Court Bar Association thinks that, those judicial process are going for due cause and absolutely in accordance with law and on strict compliance of legal formalities. If Dr. Muhammad Yunus is aggrieved at any stage of legal process, he has proper remedy and redress in the law itself. Government of the People's Republic of Bangladesh filed no cases against Dr. Muhammad Yunus on Labour issues, rather those are filed by the oppressed labours for materializing their legal, lawful and genuine claim and right, according to the statement.
“The judiciary of Bangladesh are absolutely independent and impartial. The Hon'ble Judges have been discharging their duties independently, impartially and within the domain of law. The executives have no scope and authority to interfere in the functions of the judiciary.”
“The Constitution of the People's Republic of Bangladesh is an instrument with the embodiment and recognition of all fundamental and natural rights of human. As per this constitution nobody is above law and it is in alienable right of every citizen to get protection of law and get shelter of law. The labours, as citizens of the country, have right to take protection of law. Dr. Muhammad Yunus is also not above law.”
Such open letter is undue interference in the internal affairs of Bangladesh and undue interference upon independent and impartial judiciary and detrimental to the just and lawful right of the poor labours. This is also against international law. This is unexpected and unwarranted, the statement reads.
